By accessing or using the On My Flow platform and services ("Service"), including SMS messaging features, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
On My Flow provides AI-powered agent assistants that can communicate with users via SMS text messaging, email, and HTTP. The Service allows users to create, configure, and interact with AI agents that process and respond to messages on their behalf.
3. Eligibility
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
5. SMS Messaging Terms
By opting in to receive SMS messages from On My Flow agents, you agree to the following:
- You consent to receive automated text messages from AI agents you interact with
- Message frequency varies based on your usage and agent configuration
- Message and data rates may apply depending on your wireless carrier and plan
- You may opt out at any time by replying STOP to any message
- You may request help at any time by replying HELP to any message
- Consent to receive messages is not a condition of purchasing any goods or services

6. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or bulk messaging through On My Flow agents
- Harass, abuse, or harm any person
- Violate any applicable law, regulation, or third-party rights
- Transmit any malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any illegal, fraudulent, or deceptive purpose
- Impersonate any person or entity
- Interfere with or disrupt the integrity or performance of the Service
7. AI-Generated Content
The Service uses artificial intelligence to generate responses. You acknowledge that:
- AI-generated responses may not always be accurate, complete, or appropriate
- You should not rely on AI-generated content for medical, legal, financial, or other professional advice
- On My Flow does not guarantee the accuracy or reliability of any AI-generated content
- You are responsible for reviewing and verifying any information provided by AI agents
8. Intellectual Property
The Service, including its design, features, and content, is owned by On My Flow, Inc. and is protected by intellectual property laws. You retain ownership of content you provide to the Service. By using the Service, you grant On My Flow a limited license to process your content solely for the purpose of providing the Service.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including phone numbers and message content.
10. Fees and Payment
Certain features of the Service may require payment. If you subscribe to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by law. We reserve the right to change pricing with reasonable notice.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ON MY FLOW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ON MY FLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Wireless carriers are not liable for delayed or undelivered messages.
14. Indemnification
You agree to indemnify, defend, and hold harmless On My Flow, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and Messaging Policy, constitute the entire agreement between you and On My Flow regarding the use of the Service.
